Terms of Service

These Terms govern use of the FixMyWhip platform during private beta. By creating an account, using the platform, accepting a quote, or submitting a mechanic quote, you agree to them.

Platform Scope

FixMyWhip is a technology marketplace that helps owners and mechanics connect, communicate, and manage repair jobs.

FixMyWhip does not perform repairs and is not a repair facility, towing operator, parts supplier, insurer, warranty provider, or emergency dispatch service.

Eligibility And Accounts

You must be at least 18 years old, legally able to enter agreements, and provide accurate account information.

You are responsible for activity under your account and for keeping login credentials secure.

Owners must have authority to request service for the vehicle they post. Mechanics must have authority to act for the business or repair operation they register.

Electronic Records And Signatures

By creating an account and using FixMyWhip, you consent to receive and use electronic records, notices, disclosures, policy updates, quote records, job records, cancellation records, dispute records, payment-status records, and support communications through the platform or the email address on your account.

Actions such as checking required boxes, submitting a quote, accepting a quote, approving scope changes, marking work complete, opening a dispute, or sending support records may be treated as electronic signatures or electronic acknowledgments where allowed by law.

You are responsible for keeping your email address current. You may contact Support for help accessing records or for questions about withdrawing electronic-record consent, but withdrawal may limit your ability to use platform workflows.

Owner And Mechanic Responsibilities

Owners are responsible for accurate vehicle and request details and for cooperating in scheduling and access.

Mechanics are independent businesses and are responsible for licensing, insurance, compliance, estimates, repair quality, warranties, and lawful service delivery.

These Terms do not waive any non-waivable estimate, authorization, invoice, replaced-parts, safety, consumer-protection, or repair-facility obligations that apply to a mechanic's work.

Quotes, Acceptance, And Job Commitments

Mechanics must submit clear, good-faith quotes with labor, parts, and deposit details.

When an owner accepts a quote, a job ticket is created and both parties are expected to follow the agreed scope unless a documented scope change is approved.

Mechanics must obtain owner approval before additional billable work or material scope changes, and must preserve required estimate, authorization, invoice, and repair records when applicable.

Payments During Beta

Posting a request is free. The current model tracks or charges a non-refundable deposit at quote acceptance and tracks or charges final balance at mechanic completion.

When Stripe automation is enabled, owner checkout requires the accepted mechanic to have a transfer-ready connected account, and destination charges route confirmed payments to that connected account. Bank payout timing follows Stripe schedule and eligibility.

Refund exceptions and payment adjustments may be manually reviewed by admin during beta.

Cancellations, Disputes, And Enforcement

Cancellation and dispute handling is governed by the Cancellation & Refund Policy and Dispute Policy, including required reason capture and dispute-window rules.

FixMyWhip may suspend, limit, or remove accounts for fraud, abuse, policy violations, safety risks, or repeated non-compliant behavior.

Content, Communications, And Safety

You may only upload content you have rights to share, and it must be truthful and relevant to the requested service.

Harassment, threats, discrimination, impersonation, falsified evidence, and attempts to bypass platform controls are prohibited.

FixMyWhip is not an emergency service. Urgent labels and timing preferences do not guarantee emergency response, roadside help, towing, or same-day service.

Service Limitations

FixMyWhip may update, pause, or discontinue features during beta and does not guarantee uninterrupted service or specific mechanic response times.

To the maximum extent allowed by law, platform liability is limited to operating the marketplace workflow and related support tools, and FixMyWhip is not responsible for independent mechanic services, repair outcomes, warranties, vehicle damage, injuries, delays, or indirect losses.

Users accept the Safety & Liability Acknowledgment as part of account creation and continued platform use.

Indemnity And Claims

Mechanics agree to defend and indemnify FixMyWhip from claims arising from their services, estimates, repairs, personnel, facilities, licenses, insurance, taxes, invoices, warranties, legal compliance, misconduct, or breach of the Mechanic Agreement.

Owners and mechanics agree to bring claims against FixMyWhip individually and only to the maximum extent permitted by law. Attorney review must finalize any arbitration, class-action, venue, and governing-law language before public launch.

Policy Updates

We may update these Terms and related policies as the beta evolves. Material updates will be reflected by policy version/date updates.

Continued platform use after an update means you accept the updated Terms.
