Safety & Liability Acknowledgment

This acknowledgment explains the risk boundaries for using FixMyWhip as a marketplace, including independent mechanic work, vehicle safety, estimates, emergencies, warranties, and claims.

Marketplace Role Only

FixMyWhip operates a technology marketplace for repair requests, quotes, messaging, job records, payment-status tracking, cancellations, disputes, and support review.

FixMyWhip does not inspect, diagnose, maintain, tow, store, or repair vehicles and is not a repair facility, towing operator, parts supplier, insurer, warranty provider, or emergency service.

Mechanics are independent businesses or independent contractors. They are responsible for their own estimates, inspections, repairs, workmanship, personnel, tools, facilities, licensing, insurance, taxes, invoices, warranties, and legal compliance.

Vehicle And Repair Risks

Vehicle diagnosis and repair involve safety, property, mechanical, electrical, environmental, towing, storage, and transportation risks.

Owners are responsible for deciding whether a vehicle is safe to drive, tow, store, or release for service and should use qualified emergency, towing, insurance, or legal help when appropriate.

Owners must have legal authority to request service for the vehicle and must provide truthful vehicle, title, access, location, symptom, warning-light, drivable-status, and safety information.

No Repair Guarantee

FixMyWhip does not guarantee that a mechanic will respond, quote, appear, complete work, diagnose correctly, use particular parts, meet a timeline, charge a final amount, or deliver a particular repair outcome.

Any warranties, repair promises, parts terms, estimate details, shop-supply charges, replaced-parts handling, final invoices, or post-repair obligations are the mechanic's responsibility unless FixMyWhip expressly states otherwise in writing.

Owners and mechanics should keep scope, approval, price, timing, warranty, invoice, replaced-parts, and completion evidence inside the platform whenever possible.

Emergency And Safety Limits

FixMyWhip is not an emergency dispatch service. Urgent labels, timing preferences, mobile-service preferences, messages, or support review do not guarantee emergency response, towing availability, roadside safety, or same-day service.

If a person, vehicle, road condition, fire, leak, crash, medical issue, crime, or other safety condition needs immediate help, users should contact emergency services, roadside assistance, towing, insurance, or qualified local professionals instead of relying on FixMyWhip.

Claims Against FixMyWhip

To the maximum extent allowed by law, users agree that FixMyWhip is not liable for claims arising from independent mechanic services, vehicle condition, repair quality, diagnostic decisions, parts selection, shop practices, towing or storage decisions, missed appointments, delays, warranties, injuries, property damage, lost profits, loss of use, or indirect or consequential damages.

Nothing in this acknowledgment limits rights that cannot legally be limited, including non-waivable consumer, safety, fraud, or regulatory rights.

FixMyWhip may still support users through cancellation, refund, dispute, trust/safety, and account-enforcement workflows when the platform record supports review.

Mechanic Indemnity

Mechanics agree to defend, indemnify, and hold FixMyWhip harmless from claims, losses, damages, penalties, costs, and expenses arising from their services, estimates, inspections, repairs, personnel, facilities, licenses, insurance, taxes, invoices, warranties, consumer-law compliance, safety practices, misconduct, or breach of the Mechanic Agreement.

This obligation applies to the extent allowed by law and does not replace a mechanic's required insurance, licenses, records, or customer-facing repair obligations.

Off-Platform Conduct

FixMyWhip cannot reliably review or support promises, payments, work authorization, evidence, or disputes that users move outside the platform.

Attempts to bypass platform records, pressure another user into off-platform payment or service arrangements, falsify evidence, or hide material facts can limit support options and may affect account standing.
